These Terms of Service, together with any additional terms they expressly incorporate by reference (collectively, the “Terms”) govern the use of www.canadarunningseries.com (the “Site”) and any related services offered by Canada Running Series (the “Services”), including email and SMS communications. This Site is owned and operated by Canada Running Series.
By using this Site or opting into our Services, you confirm that you have read, understood, and agree to be bound by the Terms at all times. If you do not agree to the Terms, you must not access or use the Site or the Services.
1. Communications and SMS Program
By providing your phone number and opting in, you consent to receive SMS (text) messages from Canada Running Series. These may include:
- Race registration updates and reminders
- Event announcements and promotions
- Training tips and partner offers
- Operational updates (e.g. race day info, weather alerts)
Message Frequency
Message frequency varies based on your participation, but you can expect 2–6 messages per month per event, with additional messages closer to race day.

Message and data rates may apply depending on your mobile carrier and plan.

You can opt out at any time by replying:

After opting out, you will no longer receive SMS messages from Canada Running Series unless you re-subscribe.
Carrier Disclaimer
Neither the phone carriers nor Canada Running Series is liable for any delayed or undelivered messages.
2. Privacy
Your privacy is important to us. Information collected through SMS, email, or the Site is handled in accordance with our Privacy Policy.
We do not sell or share your phone number with third parties for their own marketing purposes.
3. Intellectual Property
All content, features, and functionality published and/or made available on our Site (collectively, the “IP”) is the property of Canada Running Series and its creators, as applicable. This includes, but is not limited to:

- Logos
- Race materials
- Downloadable content
You must not use any of the IP without the prior written permission of Canada Running Series. Use of any of the IP, except as expressly authorized, shall constitute an infringement or violation of the rights of the property owner and may be a violation of federal or other laws and could subject you to legal action.
You may only use the Site for your personal and non-commercial use. You shall not directly or indirectly reproduce, compile for an internal database, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, in any form or medium whatsoever except:
- your computer and browser may temporarily store or cache copies of materials being accessed and viewed; and
- a reasonable number of copies for personal use only may be printed keeping any proprietary notices thereon, which may only be used for non-commercial and lawful personal use and not for further reproduction, publication, or distribution of any kind on any medium whatsoever.

Canada Running Series is not responsible for and we do not have any liability whatsoever for the content, policies, or practices of any third-party websites or services.

Although Canada Running Series makes reasonable efforts to update the information on our Site, we make no representations, warranties, or guarantees, whether express or implied, that the content on our Site is accurate, complete, or up to date. Your use of the Site is at your own risk and neither Canada Running Series nor its affiliates, and their respective directors, officers, employees, agents, service providers, contractors, licensors, licensees, suppliers, or successors (collectively, the “Affiliates”) have any responsibility or liability whatsoever for your use of this Site.

Canada Running Series, including its directors, officers, employees, personnel, and affiliates, will not be liable for any actions, claims, losses, damages, or expenses arising from:

- Your participation in Canada Running Series events
- Your use of our Services (including SMS or email)
EXCEPT WHERE SUCH EXCLUSIONS ARE PROHIBITED BY LAW, UNDER NO CIRCUMSTANCE WILL CANADA RUNNING SERIES OR ITS AFFILIATES BE LIABLE FOR NEGLIGENCE, GROSS NEGLIGENCE, NEGLIGENT MISREPRESENTATION, FUNDAMENTAL BREACH, DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT, BREACH OF CONTRACT, BREACH OF PRIVACY, OR OTHERWISE, EVEN IF THE PARTY WAS ALLEGEDLY ADVISED OR HAD REASON TO KNOW, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OR RELIANCE ON, THE SITE, ANY LINKED WEBSITES OR SUCH OTHER THIRD-PARTY WEBSITES, OR ANY SITE CONTENT, MATERIALS, POSTING, OR INFORMATION THEREON.
7. Indemnity
By using this Site, you agree, to the maximum extent permitted by applicable law, to indemnify and hold Canada Running Series and its Affiliates harmless from any claims, damages, or expenses arising from your use of the Site and/or Services or your violation of these Terms.
8. Applicable Law [and Choice of Forum]
The Site and these Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without giving effect to any choice or conflict of law provision, principle, or rule, and notwithstanding your domicile, residence, or physical location.
Any action or proceeding arising out of or relating to this Site or the Services and under these Terms and will be instituted in the courts of the Province of Ontario and/or the Federal Court of Canada, and you irrevocably submit to the exclusive jurisdiction of such courts in any such action or proceeding. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue of such courts.
9. Severability
If any provision of these Terms is found to be invalid or unenforceable in any jurisdiction, such invalidity or unenforceability will not affect any other provision of these Terms or invalidate or render unenforceable such provision in any other jurisdiction.
10. Entire Agreement
The Terms constitute the sole and entire agreement between you and Canada Running Series regarding the Site and Services and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
11. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page and, where appropriate, communicated via email or SMS. Any and all such amendments are effective immediately upon posting and apply to all access to and continued use of the Site and Services. You agree to periodically review the Terms in order to be aware of any such modifications and your continued use shall be your acceptance of these.
